Terms of Service

Effective version 2.2. These Terms govern access to Trade Cycle Bot (“TCB”), the hosted trading-automation software and related services (“we”, “us”). Legal contact: [email protected].

1. Service

TCB is software that can connect to supported third-party cryptocurrency exchanges through API credentials supplied by the customer. Depending on the selected plan, Trade Cycle Bot may provision and administer a virtual server, install TCB, provide updates, licensing, documentation and operational tooling. Exchange availability, trading pairs, margin products and API capabilities depend on the customer’s exchange account, jurisdiction and the exchange’s current rules.

After Trade Cycle Bot validates the first subscription payment, Trade Cycle Bot’s target is to make the service available within forty-eight (48) hours. Security checks, third-party outages or information required from the customer may extend that timeframe.

2. Eligibility — Chilean citizens

The Service is offered and contractually intended only for Chilean citizens. By accepting these Terms and contracting or using the Service, the customer represents and warrants that they are a Chilean citizen. No separate nationality checkbox, KYC procedure or independent nationality verification is required from Trade Cycle Bot, and Trade Cycle Bot may rely on the representation made through acceptance of these Terms. A person who is not a Chilean citizen and nevertheless contracts or uses the Service does so in breach of these eligibility terms. Trade Cycle Bot’s decision not to verify nationality does not create responsibility for a false representation made by the customer, subject always to mandatory applicable law.

3. No financial or investment advice

TCB is a software tool and does not provide investment, financial, tax, legal or fiduciary advice. Indicators, formulas, backtests, statistics, targets, capital recommendations, market-regime labels and automated decisions are algorithmic outputs, not promises or personalized recommendations. Past performance and simulated results do not guarantee future results.

4. Trading risk

Cryptocurrency trading can result in partial or total loss of capital. The customer accepts risks including volatility, slippage, illiquidity, exchange outages, API changes, rejected or delayed orders, network failures, VPS failures, software defects, inaccurate or unavailable market data, liquidation and borrowing costs where margin is used. The customer remains responsible for capital allocation, exchange permissions, API-key security and deciding whether live trading is appropriate.

5. Accounts and security

The customer must provide accurate registration information, protect credentials, use exchange IP whitelisting when available and grant only necessary API permissions. Trade Cycle Bot may rate-limit, temporarily block or require additional verification when activity appears abusive, automated or unsafe.

6. Subscriptions and automatic renewal

Monthly subscriptions renew monthly and annual subscriptions renew annually until cancelled. Charges are processed by our payment provider. The price, billing interval, taxes and renewal terms are shown before checkout. The customer authorizes recurring charges to the selected payment method until cancellation takes effect.

7. Failed payment, suspension and termination

If a renewal is not successfully paid, the service may enter PAST_DUE or SUSPENDED status. Suspension may last for up to fifteen (15) days. During suspension, TCB may prevent new exposure-increasing activity, including new buys, DCA or new borrowing, while certain exit or protection functions for existing positions may remain available depending on version, exchange availability and configuration. Trade Cycle Bot does not guarantee that protective actions can always execute.

If payment remains outstanding at the end of the suspension period, Trade Cycle Bot may terminate the service. A backup may be retained for up to six (6) months solely to support a possible paid reactivation or recovery, after which it may be permanently deleted. Recovery is not guaranteed if the backup is corrupted, incompatible or unavailable.

8. Cancellation

Cancellation stops future renewals and normally leaves the service available until the end of the already-paid billing period, subject to these Terms. Statutory consumer rights that cannot legally be waived remain unaffected.

9. Refunds and withdrawal rights

Refunds are governed by the Refund & Cancellation Policy and applicable mandatory law. Nothing in these Terms removes any non-waivable consumer right. Where legally valid for immediate digital-service performance, additional express consent may be collected at checkout.

10. Supported exchanges and third parties

Exchanges, DigitalOcean, PayPal, optional Stripe services, DNS/CDN providers, email providers and other infrastructure are independent third parties. Trade Cycle Bot does not control their availability, solvency, security, API behavior or regulatory restrictions. TCB compatibility can change when a third party changes its API or products.

11. Acceptable use

The customer may not use TCB to violate law, exchange rules, sanctions, security controls or third-party rights; attempt unauthorized access; interfere with the service; resell credentials or licenses without written permission; reverse engineer protected components except where mandatory law permits; or use the service to attack or overload infrastructure.

12. Intellectual property

TCB software, branding, proprietary indicators, documentation and related materials remain the property of Trade Cycle Bot or its licensors. A valid subscription grants a limited, non-exclusive, non-transferable right to use the service for the subscribed installation(s).

13. Availability, updates and changes

The service is provided on an “as available” basis. We may deploy security fixes, exchange-adapter changes, documentation updates and feature changes. We may temporarily interrupt service for security, emergency maintenance or third-party incidents. No uninterrupted or error-free operation is guaranteed.

14. Limitation of liability

To the maximum extent permitted by applicable law, Trade Cycle Bot is not liable for trading losses, lost profits, lost opportunities, indirect or consequential loss, exchange failures, third-party outages, customer configuration errors, compromised customer credentials or events outside our reasonable control. Where liability cannot be excluded, Trade Cycle Bot’s aggregate contractual liability should be limited, to the extent legally permitted, to the service fees actually paid by the customer during the six months preceding the event giving rise to the claim. This limitation does not apply where mandatory law prohibits it.

15. Indemnity

To the extent permitted by law, the customer agrees to indemnify Trade Cycle Bot against third-party claims arising from unlawful use, breach of exchange rules, misuse of API credentials or material breach of these Terms.

16. Changes to terms

Material changes may require re-acceptance. The portal records the document version, acceptance time and integrity hash so the applicable version can be identified.

17. Governing law and jurisdiction

These Terms are governed by the laws of the Republic of Chile. To the maximum extent legally permitted, any dispute arising out of or relating to the Service, these Terms, billing, software operation or the commercial relationship shall be submitted exclusively to the competent ordinary courts of justice located in Santiago, Chile. Mandatory rights or procedural rules that Chilean law does not permit the parties to waive remain unaffected.
